Your Inked Brothers Agreement
Terms of Service
Inked Brothers provides a web platform for ordering Direct-To-Film (DTF) transfers. Orders are submitted via our API or an approved e-commerce platform, then Inked Brothers prints the custom DTF transfers (“Products”) and ships them to customers (“Customers”). This entire system constitutes the Inked Brothers Service (“Service”).
All use of the Inked Brothers Service, plugins (“Application”), and InkedBrothers.com (the “Website”) is governed by these terms, available in the footer of the Website and Application.
The Application and Website are owned by Inked Brothers, based in Cedar Park, Texas. By using the Inked Brothers Service, you agree to abide by these terms and conditions in their entirety.
Using Inked Brothers
To use the Inked Brothers Service, users must agree to all terms and maintain accurate personal and payment details. Users can opt out of promotional emails without canceling this agreement.
New users register via the Website or Application. Users are responsible for securing their account information and must report any credential breaches to Inked Brothers, which is not liable for any resulting losses. Unauthorized access to other users' accounts or information is prohibited.
Inked Brothers may change, suspend, or stop Services, Products, charges, or fees at any time, without notice or liability.
Users must be 18+ unless representing a business entity. This agreement is void where prohibited by law.
Changes to Terms
Inked Brothers reserves the right to modify terms, prices, and policies at any time. Continued use of the Inked Brothers Service implies acceptance of any updates.
Creative Content & Copyright Policy
Users must own or have permission to use any Designs uploaded. By uploading, users grant Inked Brothers the right to reproduce artwork for printing and display it in portfolios and marketing materials unless specified otherwise. Inked Brothers may review and remove
infringing content or cancel accounts for violations. Users bear responsibility for all Designs uploaded.
Inked Brothers will not share users' intellectual property with third parties outside of the Service.
Taxes
All orders are subject to taxes, including local Texas sales tax.
Order Changes
Once submitted, orders cannot be edited or canceled. Contact Inked Brothers promptly for any alterations; adjustments may be possible but are not guaranteed.
Returns
Due to product nature, returns are generally not offered. However, reprints may be provided for printing errors where Inked Brothers is at fault. The Carrier assumes responsibility for shipped Products; users must file claims with the Carrier for lost items.
Payment & Fees
Users authorize Inked Brothers to save payment details for future transactions. All charges are in USD. Chargebacks incur a $15 fee. Payments must be made in full before order processing.
Account Creation & Data Storage
Temporary guest accounts last 30 days; full account setup is recommended. Users are responsible for securing accounts. Artwork tied to accounts is private, but users should keep backups.
Visitors Policy
Violation of Visitors Policies may lead to account termination. Users assume responsibility for Designs and information submitted. Inked Brothers may cancel or suspend services that violate policies or create liabilities.
Product Descriptions
Inked Brothers updates products and prices regularly. While product colors and details are represented accurately, exact matches are not guaranteed.
Purchase of Products
An order submission constitutes an offer, accepted only upon confirmation from Inked Brothers. Users and Customers must ensure all information is accurate to facilitate order delivery.
Delivery
Orders typically ship within two business days of submission. Delivery dates are estimates, subject to change. Additional shipping charges may apply for certain locations. Orders may be shipped separately and may not have identical delivery dates.
Release
Users release Inked Brothers from claims or damages related to this agreement. Inked Brothers cannot guarantee delivery once products are with the Carrier.
Trademarks
The Inked Brothers trademark is proprietary. Any use must clearly indicate Inked Brothers' ownership and relationship to the Service.
Indemnity
Users indemnify Inked Brothers from claims or legal actions arising from agreement breaches or legal violations.
Legal
Any dispute with Inked Brothers must be resolved in a Williamson County, Texas court.
General
No agency, partnership, or employment relationship is implied by this agreement. Users certify the right to share Customers' personal data for shipments. Invalid provisions will be struck, and the remainder enforced. Inked Brothers may transfer this Agreement and its rights at any time.
